Remote Support and LogMeIn Access Disclaimer

1. Purpose and Scope

This disclaimer governs all remote support sessions provided by COS Business Solutions Pty Ltd (“COS”, “we”, “our”, “us”) to you (“the Client”, “you”, “your”) using LogMeIn or any other authorised remote access software (collectively, “Remote Support Services”). 

By requesting, accepting, or participating in a remote support session, you acknowledge that you have read, understood, and agree to be bound by the terms set out in this Disclaimer.

2. Authorised Access

2.1 Remote Support Services will only be initiated by an authorised COS representative and conducted with your express consent.

2.2 You must not allow access to your systems or data by any person claiming to represent COS unless the session has been arranged directly through our official communication channels.

2.3 You are responsible for verifying the identity of the support representative before granting access.

3. Acknowledgement of Risk

3.1 While COS exercises all reasonable care and utilises industry-standard security practices, remote access inherently carries certain risks, including but not limited to:

  • unintended data modification, loss, or corruption;
  • temporary disruption of systems or applications;
  • unauthorised access if third parties compromise your credentials; and
  • failure of software or hardware outside our control.

3.2 By proceeding, you acknowledge that you understand and accept these risks and that remote assistance is provided at your own risk.

4. Consent to Access and Processing

4.1 By accepting a LogMeIn session, you grant COS temporary, revocable permission to access your computer system, network, or device for the sole purpose of diagnosing and resolving the issue described.

4.2 You may terminate the remote session at any time.

4.3 You acknowledge that during the session, COS may view system files, configurations, and data relevant to the issue, and you consent to such limited access.

4.4 COS will not intentionally view, copy, store, or otherwise process any personal or confidential information unrelated to the technical issue being addressed.

5. Privacy and Data Protection

5.1 COS is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

5.2 Any personal information collected during the session will be handled strictly for the purpose of providing technical support and will not be retained beyond what is necessary to complete the service or comply with legal obligations.

5.3 You are encouraged to back up all critical data before granting remote access.

6. LogMeIn Terms and Third-Party Conditions

6.1 COS utilises LogMeIn (operated by GoTo Group, Inc.) as a third-party platform to facilitate secure remote connections.

6.2 By accepting a LogMeIn session, you acknowledge that you have reviewed and agree to be bound by LogMeIn’s Terms of Service and Privacy Policy, available at https://www.goto.com/company/legal.

6.3 COS has no control over and accepts no responsibility for the performance, availability, or security of the LogMeIn platform.

7. Limitation of Liability

7.1 To the maximum extent permitted by law, COS, its officers, employees, and agents shall not be liable for any loss, damage, cost, or expense (including indirect, special, incidental, or consequential loss or damage) arising out of or in connection with:

  • the provision or use of Remote Support Services;
  • reliance on advice or information provided during the session; or
  • the operation or performance of the LogMeIn platform.

7.2 Nothing in this clause excludes liability that cannot be lawfully excluded under the Australian Consumer Law or any other applicable legislation.

8. Indemnity

8.1 You agree to indemnify and hold harmless COS, its officers, employees, contractors, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including legal fees on a full indemnity basis) arising out of or in connection with:

  • your use of Remote Support Services;
  • failure to identify improper and scam use of the service;
  • any breach of this Disclaimer; or
  • any act or omission by you, your employees, or your representatives during or after the remote session.

9. Termination and Withdrawal of Consent

You may withdraw consent and terminate the remote session at any time. COS may also suspend or terminate a session immediately where security, privacy, or operational risks are identified.

10. Governing Law

This Disclaimer is governed by the laws of Queensland, Australia, and you agree to submit to the exclusive jurisdiction of the courts of that State.
